Jubilation In Wike’s Camp As Appeal Court Vacated The Order of Hon. Justice C.N Wali

– Said, there was no contention on the speakership of Rt. Hon. Martins Amaewule from the records, and therefore, Martins Amaewule remains the speaker.

The Notice of Preliminary Objections filed by Hon. Victor Oko Jumbo, Hon. Sokari Goodboy Sokari, Hon. Adolphus Timothy, and Governor of Rivers State being the 1st, 2nd, 3rd, and 4th Respondents challenging the Appeal of Hon. Martin Chike Amaewhule and 24 others have been dismissed for lacking in merit.

Said the Court vested with Jurisdiction to entertain the suit of Hon. Oko Jumbo and others is the Federal High Court and not the State High Court.

“The consequent upon the foregoing, the order of the trial court having been made without Jurisdiction is of no effect and is hereby declared null and void”- Appeal Court.

According to an apolitical constitutional jurist, Gideon Deemor;
the implications of the judgment of the Court of Appeal are:
1) All actions taken by Hon.Oko Jumbo including screening, and confirmation of illegal Commissioner nominees and Caretaker committees are null and void.

2) All monies spent by Gov. Fubara without proper approval given to the budgeting and Appropriations by Rt
Hon.Martins led House of Assembly is illegal.

3) All laws made by Rt. Hon. Martin’s led Assembly is now in force including the extension of the Tenure of Elected Chairmen, Vice Chairmen, and Councillors.
Rt. Hon.Martins immediately seat and pass the Resolution for the extension of the Tenure in line with Section 9(1) No.5, Rivers State Local Government Law, 2018 as amended, now referred to as Rivers State Local Government Law No.4, 2024 as amended which is consistent with the Constitution.
The implication is also that Rivers State is without an Attorney General and Commissioner for Justice.

Issue 1: The record of Appeal is not invalidated. Therefore, the appeal has life.

Issue 3: The Appeal Court has jurisdiction to entertain the matter.

Issue 2: The Hon. Martins Amaewhule’s led RSHA members have the right of appeal as their constitutional right and can not be taken away from them.

Issue 4: Determined

Only the Federal High Court and no other court has the jurisdiction to determine cases of tenures and vacancies of House of Assembly, Governors, and President and not the State High Courts (Rivers State High Inclusive).

Issue: From the foregoing, it is of the view of the learned judges that there was no contention on the speakership of Rt. Hon. Martins Amaewule from the records, and therefore, remains the speaker.
Every action taken by Oko Jumbo is null and void.

Issue 7: The injunction granted by the Rivers State High Court against the Rt. Hon. Martins Amaewule led RSHA is null and void.
